The old driver does not have a software-based authenticity determination function.
So if the product is fake, the driver is just being deceived.
If the product is faulty or misidentified as a fake, NI may replace the product.
If NI's judgment is "counterfeit", please complain to the place of purchase.

Well here's a thing: I suspect I got an counterfeit adapter, but I have no way in contacting NI in writing since I don't have a service contract and the website totally revolves around spending money for one, and I cannot even report a software bug because that requires a serial number, which on that specific page is not recognized. But check this out:

NI-488.2 version 2022 Q4 (serial number is prefixed with a 0, but no sign of the "this is a counterfeit product" warning)
It's working properly with a scope, and all the adapter, packaging, paperwork and CD stuff looks absolutely genuine (including a trail of matching serial numbers) except for one sticker on the cardboard box says "Baord". Well, and the fact that this GPIB-USB-HS is listed as PXIe-7862 after registering it via the popup window after driver install.
If someone from NI could please contact me and confirm that this is a fake adapter - I'd very much like to let Amazon US know that they've shipped counterfeit goods internationally 🙃
