VISA open error 1073807246 on 54642A scope.

I have a Agilent 54642A scope connected to COM1.  I can send queris to the scope via MAX.  When I try to run VI example Agilent 546XX Serice Acq Digital Wfm Edge Triggered.vi, I get erro 1073807246

And do you have MAX still open? A search for the error would have shown that the OS does not allow multiple processes to access the same port.
