COM port on new NI-1426 always returns data in buffer.

I have a new NI-1426 that is showing data in the buffer to be read (using camera link call function clGetNumBytesAvail).  This is after the flush port has been called.  The odd thing is that every call to see if data is present returns a random value.
 
The board passes self test and will acquire digital data but my application uses the COM port extensively and obviously this creates a problem.  Wondering if any changes have been made to on board firmware that might be causing this problem or if I should just return the board and request replacement.  I did upgrade to Vision Acquisition 8.2.3 (IMAQ 3.7.1) - but my older 1426's still work as before.
