So it was: sorry your driver was installed but it doesn't work properly.
In the device manager on the driver tab was error code 39 then.

Does the device show up in the Windows Device Manager with no errors? That is the first place to start. If Windows doesn't see it properly then there is no chance MAX will see it, and no chance LabVIEW will see it.

To update the thread - we were troubleshooting via email and it seems that there is some problem with the motherboard - after removing all cards except the PCI-CAN it worked fine.
My guess is either that the PCI bus did not have enough bandwidth to handle more devices (in case of PCI is shared between them) or the motherboard could not provide enough power ( http://www.ni.com/pdf/manuals/370289p.pdf#page=657 ).
